After the reversal of Roe v. Wade, abortions are illegal within Tennessee. However, exemptions exist when the mother’s life is at risk, in which case immediate medical intervention is acceptable and legal to save her life.

What Does The Overturning of Roe v. Wade Mean?

When the Supreme Court reached its decision to reverse its original 1973 Roe decision, many Americans were shocked and left wondering what this meant.

In 1973 the Court initially ruled it was a woman’s constitutional right to obtain an elective abortion without a medical diagnosis that threatens her health, behind her decision.

However, the Court has reversed this decision and given the people back the power to decide their abortion restrictions. This means that each state may elect officials to speak on its behalf and indicate what laws will affect abortion within its territory.

What About Ectopic Pregnancies and Miscarriage Treatments?

Ectopic pregnancies and miscarriage treatments are still available and legal in all states. These are circumstances that are unavoidable and do pose a serious risk to a woman’s health. Therefore, by state law, no woman can legally be denied treatment for these pregnancy complications.

Also important to consider is the management of miscarriage and ectopic pregnancy differs from induced abortions due to the nature of their conditions.

The School of Medicine at the University of Missouri states, “Induced abortions are commonly voluntary (elective). Induced, elective abortion is in contrast to spontaneous abortion, or miscarriage, in which the embryo or fetus is involuntarily expelled because of accidental trauma or disease.”

Secondly, according to Patricia Santiago-Munoz, M.D., in contrast to abortion, “Ectopic pregnancy treatment is not the same as abortion. The medical definition of “abortion” is removal of an embryo and placenta from the uterus.” Unlike normal pregnancies, an ectopic pregnancy occurs outside the uterus and not within it.
